How this is calculated
Illinois has used three versions of the maintenance guidelines. For divorces under the 2015 through May 2018 version, the amount is 30% of the paying spouse's gross income minus 20% of the receiving spouse's gross income. For the current version (2019 to present), the amount is 33⅓% of the paying spouse's net income minus 25% of the receiving spouse's net income. In every version the receiving spouse's income plus maintenance is capped at 40% of the couple's combined income. Net income is estimated from gross income using Illinois' standardized method, where the number of dependents lowers each spouse's tax and raises their net income. Duration is the length of the marriage multiplied by a factor that increases with the years married, reaching the full length of the marriage at 20 years or more.
